Johnny Cade - From "The Outsiders"?

In the book the outsiders, they said that Johnny was charged for manslaughter for killing Bob. And after he(Johnny) died, Ponyboy got off not guilty in court. If Johnny didn't die, then would he still have to go to jail for killing Bob? BTW Johnny is my favourite character, anybody else agree?
